To Governor DeSantis and the Florida Legislature -- Please Take Action

Millions of Florida Home buyers. and 225,000 Florida Realtors® are now restricted when buying a home by a new (2024) set of rules. Only you can make it right, Governor DeSantis.

This petition requests that you take action and pass something like this: “No Consumer can be required to sign any agreement with a sales person prior to executing a sales contract.”

Florida homebuyers are now required to sign binding agreements before a Realtor® can show them a home — even if the buyers are unsure whether they intend on buying! if the customer won’t sign the agreement, the Realtor® can’t show the Consumer any homes.

A customer MUST SIGN something in order for a Realtor® to show them a house.

Before they can even see a home, many consumers are being put in the position of committing EXCLUSIVLEY to a certain Realtor® for up to as long as a year, during their very first meeting and before the consumer can adequately asses the Realtor® involved.

Here is the problem

WHY IS THIS BURDEN ON A REALTOR® CUSTOMER ALLOWED?

Is a potential car buyer required to sign a salesperson compensation agreement before they are allowed to look at a Ford?

Is a furniture salesperson required to make a customer sign a compensation agreement before they walk into a showroom?

Why must Realtors® make a potential homebuyer sign an agreement stating what the buyer will pay the Realtors® if the buyer purchases a home?

Because the National Association of Realtors and Multiple Listing Service lost a $5Billion Dollar Lawsuit. And this rule stems from a lawsuit settlement component.

However, some Consumers have refused to sign any paperwork with a Realtor® in order to even look at homes. The Realtor® then loses business.

This, “you must sign an agreement”, requirement which was part of a lawsuit settlement, restricts a Realtor’s® ability to do business compared to competitors like Developers and other Florida Real Estate Licensee’s who are not National Association of Realtors or MLS participants.

To non-attorneys like us that sounds like an unfair restraint of trade, please advise if we are incorrect and whatever it is or isn’t, we request your assistance.

Governor DeSantis and State Legislators, please protect consumers and the Florida real estate industry by making it an open, free marketplace for Florida consumers and a level playing field for all sales professionals.
